ORDINANCE NO. 666AN ORDINANCE PRESCRIBING THE GENERAL REQUIREMENTS FOR GAS PIPING AND GAS EQUIPMENT INSTALLATIONS IN THE CITY OF MEADE, MEADE COUNTY, KANSAS, INCORPORATING BY REFERENCE THE NATIONAL FUEL GAS CODE PROPOSED AND PUBLISHED BY AMERICAN GAS ASSOCIATION AND NATIONAL FIRE PROTECTION ASSOCIATION, EDITION 1980, WITH CERTAIN OMISSIONS, CHANGES AND ADDITIONS SUCH INCORPORATION BEING AUTHORIZED BY KANSAS STATUTES ANNOTATED SECTION 12-3009 TO AND INCLUDING 12-3012; PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH AND REPEALING ORDINANCE NO 662.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MEADE, MEADE COUNTY, KANSAS:
SECTION 1. There is hereby incorporated by reference for the general requirement for gas piping and gas equipment installations in the City of Meade, Meade County, Kansas, that certain fuel gas code known as the “National Fuel Gas Code” Edition 1980, prepared and published in book form by the American Gas Association and National Fire Protection Association, save and except such articles, sections, parts or portions as are hereafter omitted, deleted, modified or changed. Not less than (3) copies of said code shall be marked or stamped “Official Copy as Adopted by Ordinance No.666” with all sections or portions thereof intended to be clearly marked to show any such deletions or changes and to which shall be attached to inspection and available to the public at all reasonable hours.
SECTION 2. Section 3.1.2 (A) is hereby amended to read as follows: (A) Covering Requirements. Underground piping systems on private property shall be installed with at least 18 inches of cover and piping systems in streets, alleys and easements shall be installed with at least 36 inches of cover.
SECTION 3. Section 4.1.4 (b) is hereby amended to read as follows: (b) The test pressure for all materials approved by this code except for plastic piping as hereinafter provided for shall be no less than one an done-half (11/2) times the proposed maximum working pressure, but not less than 3 PSIG irrespective of design pressure. When the test pressure exceeds 125 PSIG, the test pressure shall not exceed a value which produces a hoop stress in the piping greater than 50 percent of the specified minimum yield strength of the pipe. Provided, however, plastic service lines and mains shall be air tested at 100 lbs. for 15 minutes and plastic yard lines shall be tested at 25 lbs. for 15 minutes.
SECTION 4. administrative Authority. The administration and enforcement of this ordinance shall be the duty of the City Superintendent who is hereby authorized to take such action as may be reasonably necessary to enforce the purpose of this code. Such persons may be appointed and authorized as assistants or agents of such administrative authority as may be necessary to carry out the provision of this code.
SECTION 5. General Penalties. Any person, firm or corporation who violates disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and such person shall be punished by a fine of not more than $100.00 or by imprisonment for not more than thirty (30) days, or by both such fine and imprisonment. Any person, firm or corporation shall be deemed guilty or a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this code is committed, continued or permitted.
SECTION 6. All Ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
SECTION 7. Repeal. Ordinance No. 662 of the City of Meade is hereby repealed.
SECTION 8. This Ordinance shall take effect and be in force from and after its passage, approval, and publication in the official city paper.
