ORDINANCE NO. 651

AN ORDINANCE PROVIDING FOR THE CREATION OF SEWER DISTRICT NO 13 IN THE CITY OF MEADE, MEADE COUNTY, KANSAS, AND PROVIDING FOR THE CONSTRUCTION OF COMPLETE SEWER SYSTEM THEREIN AND FOR THE PAYMENT OF THE COST THEREOF.

BE IT ORDAINED BY THE GOVERNING BODY OF MEADE, MEADE COUNTY, KANSAS:

SECTION 1. That the following described territory in the city of Meade, Meade County, Kansas, shall hereafter be known and designated, and is hereby created as Sewer District No. 13, to-wit:
All of Block 57, First Addition to the
City of Meade, including Lots One through
Twelve.

SECTION 2. That the sewer system be constructed according to the plans and specifications of the engineer, approved by the State Board of Health and now on file in the City Clerk’s office.

SECTION 3. The cost of said sewer lines described in Section 2 hereof shall be assessed against the lots and pieces of ground in said sewer district according to the special benefits, accruing to each lot of piece of ground therein, and special assessments shall be made by ordinance after the cost has been ascertained. The property owners shall be notified of their respective assessments and shall have thirty (30) days in which to pay the same. Any unpaid portion of the cost shall be paid by the issuance of Internal Improvement Bonds of the City of Meade, Kansas, payable in no more that ten (10) annual installments and bearing interest at the rate not exceeding eight percent (8%) per annum, payable semi-annually as provided by K.S.A., Sections 12-617; 12-618, et seq., and any amendments thereto. If it is decided that some portion of this sewer project should be paid by the city at large on the basis that it benefits the entire city, the governing body will so provide at the time the assessment ordinance is passed. This will apply primarily to outfall and/or main sewers which are found to benefit the city at large.

SECTION 4. That to provide funds to temporarily finance the cost of making these sewer improvements heretofore authorized in this ordinance, there shall be issued a temporary improvement not of the City of Meade Kansas, in the amount of Ten Thousand Dollars ($10,000.00), to be known as Note No. 1, Series 1979 (Sewer District No. 13) dated November 1, 1979, and becoming due November 1, 1981. Said note shall bear interest at the rate of Eight percent (8%).

The Mayor and City Clerk shall prepare, sign, seal and issue said note, which shall be in the usual form, all as provided by law, K.S.A., Sections 12-617, 12-618, and 10-123, and any amendments thereto.

It is understood that the note can be redeemed by the City at any time bonds are issued for this project. The governing body may deliver said note to persons having claims against the city in connection with the making of said improvements or sell the same at private sale at not less than par and accrued interest and the proceeds of said note shall be applied to the payment of actual costs and expenses of said improvement.

SECTION 5. This ordinance shall take effect and be in force from and after its passage, approval and publication as required by law.
