ORDINANCE NO. 664AN ORDINANCE RELATING TO BUILDING AND CONSTRUCTION CONCERNING WIND ENERGY CONVERSION SYSTEMS.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MEADE, KANSAS:
SECTION 1. Wind Energy Conversion Systems Defined. For purposes of this Ordinance, “Wind Energy Conversion Systems” (WECS), means any device or combinations of devices, including but not limited to wind chargers, wind mills, and wind turbines; which convert wind energy into another usable form or energy. The term shall include all associated support structures and transmission lines.
SECTION 2. WESC Permit Required. No person, firm or corporation shall install or construct a WECS unless a building permit is first obtained and said WECS complies in all other respects with the City Building Code and the following provisions of this Ordinance.
A. The WECS tower and accessory appendages must set back from all plot lines a distance equal to its height plus fifty (50) feet.
B. Guy posts, poles, or similar anchoring structures shall not be located in any required front yard and shall be located at least twenty-five (25) feet from all side and rear plot lines.
C. The design and construction of each WECS shall be certified by both a licensed electrical engineer and structural engineer and received by the City Superintendent.
D. The electrical generating device of the WECS must be equipped with an automatic and manual braking device to control movement during periods of excessive wind speeds.
E. A WECS tower shall nave a device or be so constructed so as to restrict unauthorized encroachment of the tower. If a tower is designed to include an attached ladder at least the first ten (10) feet of the ladder, or measured from ground level, shall be removable.
F. No WECS shall be permitted on a plot or tract of less than five (5) acres. The applicant shall submit a certified survey showing the amount of land contained in plot or tract.
G. Any WECS approved to be erected within the City of Meade and request an interconnection with the municipal utility shall at all times meet such utility’s then-current requirements for interconnection and operation.
SECTION 3. Penalty. Any person, firm or corporation violating any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not to exceed five hundred dollars ($500.00) or by imprisonment not to exceed six (6) months or both fine and imprisonment. Each day that any of the provisions of this ordinance shall be violated such violation shall constitute a separate offense.
SECTION 4. This Ordinance shall take effect and be in full force from and after its publication in the official city newspaper.
