ORDINANCE NO. 820
AN ORDINANCE REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT,
ALTERATION, REPAIR, MOVING, REMOVAL, CONVERSION, DEMOLITION,
OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, AND MAINTENANCE OF
BUILDINGS OR STRUCTURES IN THE CITY OF MEADE, KANSAS; PROVIDING FOR
THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFORE; DECLARING
AND ESTABLISHING FIRE DISTRICTS; INCORPORATING BY REFERENCE THE
“UNIFORM BUILDING CODE”, VOLUME 1, PREPARED AND PUBLISHED BY THE
INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS, EDITION OF 1997 OR
NEWER, WITH CERTAIN OMISSIONS, CHANGES AND ADDITIONS, SUCH
INCORPORATION BEING AUTHORIZED BY KANSAS STATUTES ANNOTATED SECTIONS
12-3009 TO AND INCLUDING SECTIONS 12-3012; PROVIDING PENALTIES FOR
THE VIOLATION THEREOF, AND REPEALING ORDINANCE NO 618 OF THE CITY OF
MEADE AND ALL ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MEADE, KANSAS:
SECTION 1. There is hereby incorporated by reference for the purpose
of regulating the erection, construction, enlargement, alteration,
repair, moving, removal, conversion, demolition, occupancy,
equipment, use, height area and maintenance of buildings or
structures in the City of Meade, Kansas; providing for the issuance
of permits and collection of fees therefore; declaring and
establishing Fire Districts; that certain building Code known as the
“Uniform Building Code”, Volume 1, Edition of 1997 or newer,
prepared and published in book form by the International Conference
of Building Officials, save and except such articles, sections,
parts or portions as are hereafter omitted, deleted, modified or
changed. Not less than two (2) copies of said Code shall be marked
or stamped “Official Copy as Adopted By Ordinance No 820” with all
sections or portions thereof intended to be omitted clearly marked
to show any such deletion or change and to which shall be attached a
copy of this ordinance, and filed with the City Clerk to be opened
to inspection and available to the public at all reasonable hours.
SECTION 2. Table 1-A in Chapter 1 relating to the headed “Building
Permit Fee”, of said Uniform Building Code is hereby declared to be
and is omitted and deleted; and the following fees are created and
established for each Building Permit issued by the Building Official
under the provisions of this Code.
A fee for each building permit shall be paid to the Building
Official at the rate of One Dollar ($1.00) for each One Thousand
Dollars ($1,000) valuation thereof or fraction thereof. A minimum
fee of Five Dollars ($5.00) shall be required for each building
permit that is issued.
The determination of value or valuation under any of the provisions
of this Code shall be made by the Building Official, as follows: In
applications for new construction wherein the applicant has not
provided to the Building Official a signed contract establishing the
construction price or the applicant has not filed with the Building
Official a sales tax receipt for mobile homes or modular homes, the
Building Official is hereby empowered to charge a construction price
of $125.00 per square foot for living area for the new construction.
For commercial applications, the Building Official shall determine
the valuation by $100.00 per square foot for the total structure to
SECTION 3. Permits issued as referenced above shall expire one (1)
year from the date of issuance of said permit. Permits May be
extended as necessary in the discretion of the City Council.
Requests shall be made in person at any regularly scheduled City
Council meeting prior to expiration of the building permit at issue.
After expiration of the one (1) year permit, any and all work
conducted pursuant to the expired permit shall cease until such time
as the applicant or his representative shall file for an additional
permit. Any and all work continued after expiration of permits
issued under this section shall be subject to the penalties as
listed in section 5.
SECTION 4. Section 108.7 relating to inspections and titled “Other
Inspections”, of said Uniform Building Code is hereby omitted and
deleted; and in addition to called inspections specified in said
Uniform Building Code, the Building Official may make or require an
other inspections of any construction work to ascertain compliance
with the provisions of this Code and other laws which are enforced
by the Building Departments.
For the purpose of determining compliance with Section 108.7, the
Building Official may cause any structure to be re-inspected.
SECTION 5. GENERAL PENALTIES. It shall be unlawful for any person,
firm or corporation to erect, construct, enlarge, alter, move,
improve, remove, convert or demolish, equip, use, occupy, or
maintain any building or structure in the City, or cause the same to
be done, contrary to or in violation of any of the provisions of
said Code. Any person, firm or corporation violating any of the
provisions of this Code shall be deemed guilty of a misdemeanor and
each such person shall be deemed guilty of a separate offense for
each and every day or portion thereof which any violation of any of
the provisions of this Code is committed, continued or permitted,
and upon conviction of any such person shall be punishable by a fine
of not more than Three Hundred Dollars ($300) or by imprisonment for
not more than ninety (90) days, or by both such fine and
imprisonment; provided the penalties prescribed in the Uniform
Building Code incorporated by reference by Section One (1), shall
prevail as to violation of its provisions.
SECTION 6. Ordinance No 618 of the City of Meade and all ordinances
or parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed.
SECTION 7. This ordinance shall take effect and be in force from and
after its passage, approval and publication in the official city
