ORDINANCE NO. 881

            AN ORDINANCE ESTABLISHING A FEE SCHEDULE FOR KANSAS OPEN RECORDS ACT REQUESTS AND REPEALING ANY ORDINANCE IN CONFLICT HEREWITH.

            WHEREAS, the Kansas Open Records Act, K.S.A. 45-215, et seq., applies to the City of Meade, Kansas and allows for the establishment of fees for inspecting and producing copies of public records; and

            WHEREAS, the City of Meade, Kansas wishes to establish a fee schedule in compliance with the Kansas Open Records Act to recover monies for the actual costs of furnishing copies and the time spent complying with Kansas Open Records Act requests.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MEADE, KANSAS:

SECTION 1:   The City of Meade, Kansas shall hereby establish a reasonable fee schedule, as provided in K.S.A. 45-215, et seq., for the inspection and furnishing of copies of public records. The fee schedule is subject to the following:

A.     In the case of fees for copies of records, the fees shall not exceed the actual cost of furnishing copies, including the cost of staff time required to make the information available.

 

B.     In the case of fees for providing access to records maintained on computer facilities, the fees shall include only the cost of any computer services, including staff time required.

 

C.     Fees for access to or copies of public records of public agencies within the legislative branch of the state government shall be established in accordance with K.S.A. 46-1207a, and amendments thereto.

 

D.     Fees for access to or copies of public records of public agencies within the judicial branch of the state government shall be established in accordance with rules of the supreme court.

 

E.     Fees for access to or copies of public records of a public agency within the executive branch of the state government shall be established by the agency head. Any person requesting records may appeal the reasonableness of the fees charged for providing access to or furnishing copies of such records to the secretary of administration whose decision shall be final. A fee for copies of public records which is equal to or less than $.25 per page shall be deemed a reasonable fee.

SECTION 2:   Such fee schedule shall be adopted by resolution by a majority of the Governing Body of the City of Meade, Kansas.

SECTION 3:   All ordinances in conflict herewith are hereby repealed.

SECTION 4:   This Ordinance shall be in full force and effect from and after its adoption and summary of publication in the Meade County News.
